As authorized by the recently enacted FY27 State Budget, the New York State Liquor Authority is currently engaged in the rulemaking process concerning fees assessed to manufacturers and suppliers imposed by New York State wholesalers.
The Authority is seeking feedback from all New York State licensed businesses regarding the types, amounts, and operation of fees, charges, deductions, incentives, and other financial obligations that have ever been charged by licensed wholesalers in New York State.

Why Your Response Matters
New York State’s three-tier system depends on effective relationships among manufacturers, wholesalers, and retailers. Understanding how fees and other charges operate in practice is important to maintaining a healthy three-tier system and supporting abundance and affordability in New York’s alcoholic beverage industry.
It is important that the Authority hear directly from the licensees who are experiencing these practices firsthand. Your business may be affected by any changes that result from this rulemaking process. The information you provide will help the Authority develop a more complete understanding of current industry practices and consider the practical effects of potential rule changes on your business and the entire industry.
Please note, comments submitted to the New York State Liquor Authority are public records and may be subject to disclosure under the Freedom of Information Law (FOIL). If your submission contains trade secrets or confidential commercial information that you believe should be exempt from disclosure, please clearly identify and mark the specific information as “Proprietary and Confidential – Contains Trade Secrets – Not for Public Disclosure” and include a written description explaining the basis for the requested exemption. You may also provide claimed trade secret information in a separate exhibit or addendum that is marked as such.
We appreciate the time and effort involved in responding to this request and thank you for your thoughtful feedback.
